Killer Dad Defended in Comments .... UGH

This is an old article... but I wanted to share it... as just another example of a Killer Father!  The commenter's defending this man are unbelievable!  I’m glad there were several that spoke up and said that there is NO excuse for killing an innocent child.  I must note... the court had ended the joint parenting and had given the mother sole custody... so for once the court gets it right and this bad dad kills the kid anyway.  My heart goes out to the mom and her family!!

SOMERSET, Calif. -- Authorities say the bodies of a missing 2-year-old Sacramento girl and her father have been found in the man's vehicle in a rural area of El Dorado County.

FBI Special Agent John Cauthen told the Associated Press the bodies of Madeline Samaan-Fay and 49-year-old Mourad "Moni" Samaan were discovered in his green Toyota 4Runner.

The vehicle was found on private property behind a chained and locked gate.

A California HIghway Patrol helicopter spotted the vehicle. Investigators from the El Dorado County Sheriff's Department were the first to confirm two bodies inside.

"To have the case end up like this, it's tough," said El Dorado County Sheriff''s spokesman Bryan Golmitz.

Cauthen says the cause and time of the deaths is not immediately known. Investigators from the El Dorado County Sheriff's Department and the FBI are working on this case. Investigators are expected at the scene throughout the weekend, said Cauthen..

The FBI issued an Amber Alert Friday for the toddler. She was last seen Aug. 7 with her father in a Sacramento grocery store.

Samaan was served the day before with a notice that the girl's mother was awarded full custody of their daughter, ending what had been a joint custody arrangement, Cauthen said.

He then failed to return the child to her mother as expected.

Samaan had not been charged with a crime.

The mother didn't report the girl missing until Tuesday, the Associated Press reported.

Children Have A Right to A Relationship with Their Father

While attempting to write up something coherent on this news article I found a post on RandiJames.com that I’d like to share with you.  I am still currently too mad...and worried for these little girls to say anything useful here!  But Randi James put it very well:

Original Post here:  http://www.randijames.com/2010/03/children-have-right-to-relationship.html

UPDATED!! AGAIN
Does watching child porn match you a bad father? Maybe, maybe not. But who'd like to bet their own children on it? Any volunteers?
No, seriously.
A father was convicted of child pornography offenses a couple of years ago.
His wife left him.
Subsequently, the father has been trying to get access to his children.
The court previously found that he had behaved inappropriately in bed with one of the children.
But JUDGE ROBERT BENJAMIN ordered that the two children, who are girls aged 8 and 10, spend weekends with their father.
Eldest daughter is afraid.
To facilitate the father's rights, JUDGE ROBERT BENJAMIN orders that:
1. the girls sleep in the same bedroom (to "support" each other), and
2. the father place a lock on the bedroom door for the girls
3. the father have an adult friend stay overnight when the girls are present
Additionally, some UNNAMED Family Court counselor has stated that the girls don't pose a risk to the father, at their current ages, when they are awake, clothed, and together.
How considerate.
Think I'm kidding? See article here.

A summary of the rights under the Convention on the Rights of the Child
Article 3 (Best interests of the child): The best interests of children must be the primary concern in making decisions that may affect them. All adults should do what is best for children. When adults make decisions, they should think about how their decisions will affect children. This particularly applies to budget, policy and law makers.
Article 4 (Protection of rights): Governments have a responsibility to take all available measures to make sure children’s rights are respected, protected and fulfilled. When countries ratify the Convention, they agree to review their laws relating to children. This involves assessing their social services, legal, health and educational systems, as well as levels of funding for these services. Governments are then obliged to take all necessary steps to ensure that the minimum standards set by the Convention in these areas are being met. They must help families protect children’s rights and create an environment where they can grow and reach their potential. In some instances, this may involve changing existing laws or creating new ones. Such legislative changes are not imposed, but come about through the same process by which any law is created or reformed within a country. Article 41 of the Convention points out the when a country already has higher legal standards than those seen in the Convention, the higher standards always prevail.
Article 5 (Parental guidance): Governments should respect the rights and responsibilities of families to direct and guide their children so that, as they grow, they learn to use their rights properly. Helping children to understand their rights does not mean pushing them to make choices with consequences that they are too young to handle. Article 5 encourages parents to deal with rights issues "in a manner consistent with the evolving capacities of the child". The Convention does not take responsibility for children away from their parents and give more authority to governments. It does place on governments the responsibility to protect and assist families in fulfilling their essential role as nurturers of children.
Article 6 (Survival and development): Children have the right to live. Governments should ensure that children survive and develop healthily.
Article 9 (Separation from parents): Children have the right to live with their parent(s), unless it is bad for them. Children whose parents do not live together have the right to stay in contact with both parents, unless this might hurt the child.
Article 12 (Respect for the views of the child): When adults are making decisions that affect children, children have the right to say what they think should happen and have their opinions taken into account. This does not mean that children can now tell their parents what to do. This Convention encourages adults to listen to the opinions of children and involve them in decision-making -- not give children authority over adults. Article 12 does not interfere with parents' right and responsibility to express their views on matters affecting their children. Moreover, the Convention recognizes that the level of a child’s participation in decisions must be appropriate to the child's level of maturity. Children's ability to form and express their opinions develops with age and most adults will naturally give the views of teenagers greater weight than those of a preschooler, whether in family, legal or administrative decisions.
Article 19 (Protection from all forms of violence): Children have the right to be protected from being hurt and mistreated, physically or mentally. Governments should ensure that children are properly cared for and protect them from violence, abuse and neglect by their parents, or anyone else who looks after them. In terms of discipline, the Convention does not specify what forms of punishment parents should use. However any form of discipline involving violence is unacceptable. There are ways to discipline children that are effective in helping children learn about family and social expectations for their behaviour – ones that are non-violent, are appropriate to the child's level of development and take the best interests of the child into consideration. In most countries, laws already define what sorts of punishments are considered excessive or abusive. It is up to each government to review these laws in light of the Convention.
Article 34 (Sexual exploitation): Governments should protect children from all forms of sexual exploitation and abuse. This provision in the Convention is augmented by the Optional Protocol on the sale of children, child prostitution and child pornography.
Article 36 (Other forms of exploitation): Children should be protected from any activity that takes advantage of them or could harm their welfare and development.

This case is one of many, internationally, involving fathers' rights to their children. We can't all be lying.
In the words of Judge Robert Lemkau (California):
And you have an ex parte request calendared for tomorrow which I am advancing today. One of you is lying, and I am very concerned...
...I am inclined to deny you ex parte request. I feel that, if you're lying, there's going to be adverse consequences...
...I'm denying your request, ma'am. I think— there's insufficient evidence in my mind...
...Well, ma'am, there's a real dispute about whether that's even true or not...
...I'm going to deny it, ma'am. My suspicion is that you're lying, but I'm going to keep the custody orders in full force and effect...
...I reviewed it and that's why I'm -- my supposition, ma'am, is that you're lying, but if I'm incorrect, you can always bring another ex parte motion but don't misrepresent the situation. If you're lying about this, there's going to be adverse consequences. My supposition is that you are lying...

Recording Released In Murder-Suicide Case - Louisville News Story - WLKY Louisville

It is about time!  We hear all the time about these murder-suicides and everyone always makes noises about “Why was those kids even with that parent?” Well...this article gives one scenario as to how that happens.  Another scenario that is also popular is that a Family Court Judge gave them to the parent that eventually ends up killing them, but that is not the case here.

In this situation, it was a couple of cops that felt they didn’t have to read the entirety of the judges orders.  They just went on and did what they ‘thought’ they should do.

The fact that this dad turned around, not very long after he was given temporary (illegal) custody of his child, murdered his child and committed suicide; makes me wonder if he were even telling the truth about the mom in his EPO.  I think...probably not.  I think...this was another abuser that was trying to further the abuse because she left him and this was the only control that he could hold over her.

The trial is set for October in this case...so I guess we shall see if justice will be done for this small boy who’s life was ended WAY too early.

Recording Released In Murder-Suicide Case

Recording Shows Father Told Police He Didn't Have Custody Of Son

By Eric King/WLKY  POSTED: 6:24 pm EST January 28, 2010

BARDSTOWN, Ky. -- WLKY has uncovered new information in a Bardstown murder-suicide case.

WLKY obtained an audio recording of a conversation between Timothy Frazier and the Lawrenceburg Police Department. Police said in May 2009, Frazier shot his 21-month-old son in the head, then turned the gun on himself.

MP3: Listen To Police Recording

The Lawrenceburg Police Department is being sued for illegally taking the boy from his mother and placing him in the custody of his father, who according to police, later killed him.

In the call, Frazier made it clear, three times, that he did not have custody of the child.

The call came into the Lawrenceburg Police Department on May 13, just hours after Frazier filed an emergency protective order against his ex-girlfriend, Candice Dempsey, of 21-month-old Cole.

The EPO was filed in Bardstown, where Frazier lived. Dempsey lived in Lawrenceburg.

Children's Court lets dad live with daughter despite "numerous and consistent" sexual abuse disclosures

From Dastardly Dads

The daughter has disclosed abuse by her UNNAMED DAD. The Department of Human Services, the Royal Children's Hospital, and others have expressed concerns about the daughter's safety. Yet the Children's Court willy nilly permits the dad to live with the daughter anyway. What the h&*% is going on? If this girl survives her childhood, I hope she sues these bastards. Oh wait, she can't. These bastards have set up this protection racket set called "judicial immunity" so they never have to own up to anything. So they can pull all kinds of crazy sh*& with no consequences.

To Karen Hogan: Please, Honey. This isn't "difficult stuff." And you think there is "no right or wrong here"? It seems to me that this case is far from "gray" or morally complex. You either keep the child safe...or you don't. I'm not fooled at all by all the agonizing handwringing here, and neither are most people with an ounce of sense. Once again, your pals in the court failed to protect a child. They decided that Daddy's "right" to rape his own child had priority. Once again, children are treated like crap, and the "rights" of sexual predators to destroy the lives of anyone they choose is upheld. What else is new. It seems to me that moral priorities (or lack thereof) are crystal clear here. Business as usual.

Court lets father live with girl despite abuse fear
CAROL NADER
December 12, 2009
THE Children's Court permitted a man to live with his young daughter despite being aware of fears raised by child protection staff and others who had worked with the girl that he had sexually abused her.
In a complex case that has distressed many in the sector, the court went against the concerns of the Department of Human Services, the Royal Children's Hospital and others who did not believe the child, aged under 10, was safe with her father.

It is not known whether any harm has since come to the child, but it is understood that child protection is still working with the family. The Age understands the man also has a past sex offence conviction. Sources say the father denied the allegations of abuse and police investigated and no charges were laid. The Age is aware of more details that it cannot publish because they might identify the family.
Karen Hogan, manager of the Gatehouse Centre for the Assessment and Treatment of Child Abuse at the Royal Children's Hospital, said a number of her staff had worked with this family and the girl made ''numerous and consistent'' disclosures of sexual abuse.
''She was clear: 'This is what happened to me, this is what he does, I don't like it and want it to stop.' We believed what the girl said and we don't think children should be in an environment where they could be abused.''
She said it illustrated the complexity of these cases. ''We're just there to give evidence in court. We don't have an overview,'' she said. ''It's very emotional for the families and children, and all the professionals involved as well. This is difficult stuff … and so complex, and there's no right or wrong.''
The State Government has ordered a review of the way the Children's Court operates, following an explosive report on child protection services by the Ombudsman last month.
While most of the criticism was directed at the department, the report also criticised the court process for being too adversarial. Workers complained that their evidence was discredited, and the Ombudsman said sometimes the best interests of children were not being met.
Experts in the sector say this case highlights the problems with having an adversarial legal system. They say delicate cases like this would be better managed in a less combative way, with the best interests of the child the priority.
The issues are very sensitive and, in a court, it is difficult for a magistrate to use all the evidence they are presented with to make a decision about where a child should live. Some critics of the system believe magistrates are not sufficiently trained to identify signs of abuse.
Other options available to magistrates include granting orders with conditions attached, such as supervised access.
Another source involved with the family said: ''This is not about individual magistrates, it's about the system and about how the Children's Court needs to review its processes in order to ensure that the best interests of any given child are met.''
In the case, sources say the department appealed against an interim court order allowing the father regular access while the allegations were investigated because it was inappropriate for the girl to see her father after she made allegations of abuse. But the Supreme Court dismissed the appeal.
In a later decision that dismayed workers involved in the case, the Children's Court made a final order permitting the father to live with his family. It is understood that decision was not appealed because the first appeal had failed.
Sources say part of the problem is the role of lawyers, who play a big part in determining what evidence is permitted in court and who is permitted to give evidence.
Children's Court president Judge Paul Grant said in a statement released through the Department of Justice that it would be inappropriate for him to comment on decisions made by judicial officers of the court.
''The court makes judicial determinations according to law on the evidence presented by the parties … Any party who is aggrieved by a decision of the court is entitled to appeal to a superior court.''
He said in this case, the department did appeal against the interim order that was dismissed by the Supreme Court, and the final order had not been appealed against.
The Department of Human Services would not comment on the case, but said it carried out its legal obligations to administer any orders to ensure children's best interests were met.
State Government policy says children wherever possible should stay with their families. But balancing the rights of parents and children is difficult, bearing in mind the safety of children is always paramount.
Melbourne University professor in child and family welfare Cathy Humphreys said it was difficult to get that balance right.
''Everyone would want to support reunification wherever it is possible, and more resourcing and work needs to be put into that,'' she said. ''The thing is that highly adversarial processes don't support good work in this very sensitive area.''

On May 11, 2007,  just before Mother’s Day weekend, ten mothers, one victimized child, now an adult,  leading national and state organizations filed a complaint against the United States with the Inter American Commission on Human Rights. Their petition claims that U.S. courts, by frequently awarding child custody to abusers and child molesters, has failed to protect the life, liberties, security and other human rights of abused mothers and their children.  Wendy Titelman, who begins on the video, is a member of the petition…here is her situation:

The story of Wendy Titelman is well known in the United States. Her two daughters were taken from her by a Cobb County judge in Georgia at ages five and seven after sexual abuse was reported against the father who was abusive to her during the nine year marriage. She has not seen them for more than six years. She was jailed twice and acquitted by a jury once. She has filed bankruptcy. Expert after expert, witness after witness verified the child sex abuse. Rather than dealing with the confirmed sexual abuse of the children, parental alienation and mental illness were alleged against her because of her belief that the girls were telling the truth about molestation by their father.

In February of 2000, she was put on supervised visitation. In the divorce, the court made no finding of facts. The court and various related personnel clearly participated in a cover up of the abuse. In September 2000, in an ex parte hearing, the court ordered her not to come near her own children. The court did not hold a final hearing for 5.5 years, did not apply the clear and convincing legal standard as required and did not make findings of fact or conclusions of law.

Instead contempt motions have been filed against her and bogus arrest warrants, one federal and two from Georgia were served and she was jailed for five days in Mississippi and one day in Georgia. She was criminally prosecuted for custodial interference and not only did the jury return a not guilty verdict, but wrote a letter to the judge in the custody case condemning her prosecution as malicious and a cover up of the abuse. The court in Mississippi put the children in protective custody after an investigation there, but the father was successful in having them returned to Georgia where the abuse continued.

The courts have refused her petition and she has had to go to the state Supreme Court to force the lower court to accept the petition. When they were ordered to accept it, they then promptly dismissed it. She filed a federal suit for malicious prosecution and it was dismissed and the attorney sanctioned $84,000. This sanction was upheld all the way to the U.S. Supreme Court. Just recently the Georgia Supreme Court dismissed all her appeals and requests for reconsideration.

As a method of sustaining herself during this nightmare, Wendy has written a book documenting the case. The forward includes endorsements from Paul Fink, M.D., a prominent psychiatrist, Seth Goldstein, a lawyer, former investigator and instructor at the FBI academy, and Sol Gothard, a judge in Louisiana. The book details the marriage, the violence, the early years with the children, the divorce, the mother’s unceasing efforts to protect the children, the court system’s cover up of the abuse including withholding of evidence, ex parte hearings, and denial of due process, the retaliation of the system against the mother and her attorney. Exhibit 2.

It also includes documents from the children, letters, notes, emails, a court petition, reports of the abuse, professional assessments, drawings of the children, documentation of the abuse, supervised visitation reports, and expresses the deep pain, loss and grief the mother is suffering not only because she cannot see her children but knowing they are being abused and she is helpless to prevent it. This case is an extreme example of the State silencing the protective mother and putting the children directly in harms way. Unfortunately, it is not unusual.

Man Asked Daughter For Sex Online

From:  http://www.myfoxphilly.com/dpp/news/local_news/100909_Cops_Man_Asked_Daughter_For_Sex_Online

Pennsylvania state officials arrest five men, including a man who allegedly used Facebook to ask his own daughter for sex.
Attorney General Tom Corbett said on Friday that John Forehand, of Lititz, Pa., allegedly used Facebook to find and sexually proposition his own biological daughter, calling himself "Bad Daddy."

According to the criminal complaint, Forehand proposed meeting the girl for sex and explained in graphic detail the sex acts, telling her "not many other fathers and daughters are this brave, so not many of them are so lucky to experience all these pleasures."

Corbett said the girl alerted her mother, who contacted the Ephrata Borough Police Department.

The state Child Predator Unit and Ephrata Police arrested Forehand when he arrived at a predetermined meeting location on October 7. Agents seized a camera, tripod and an unopened box of condoms from Forehand's vehicle, along with a digital camera, camcorder, computers and data-storage devices from his home.

Forehand faces numerous charges and is being held on $400,000 bail.

Corbett said the other men in the sting were from Philadelphia, Pittsburgh and Schuylkill County.

Corbett identified the defendants as Timothy A. Gehres, 22, 205 East Center St., Donaldson, Schuykill County. Frank W. Bonacci, 27, 105 Legrande Drive, Pittsburgh. Michael Edward Quartucci, 27, 2544 West Girard Ave., Philadelphia and Timothy D. Anderson, 42, 141 Conestoga Blvd., Lancaster.

"Predators know that colder weather and shorter days mean that kids are spending more time inside, in front of their computers, and that many may be home alone - either before or after school," Corbett said. "As we have seen in a number of cases this year, including two of these most recent arrests, predators are reaching out to real families in Pennsylvania - and tips from those families are resulting in arrests."

Quartucci, an emergency medical technician from Philadelphia, is accused of sending nude photos and pornography to what he believed were 13-year old girls from Norristown and Pittsburgh.

Will Darcy Freeman Get Justice

By Special Guest Writer Akasha Mc Donald

The dead cannot speak.  They cannot cry when there is no justice.

"Take me away" Arthur Freeman said.

The defense lawyer continued to shift the focus on the words that were not spoken, the food that was not offered and the CTV camera that did not record.  Well dressed with a shiny purple tie, sat Arthur Freeman carefully following the movements of the lawyers, calculating the sum of words, expressions and moments nearing the end of a two day committal hearing at Melbourne Magistrates Court.  His lawyer did well to convince others that Arthur Freeman was not guilty, that he was mentally ill and not fit to stand trial.  There was more than just a few flaws that became the thread undoing the blanket of defense.  Without saying the word "catatonic", the lawyer gnarled away with questions establishing a lost cause even after it was confirmed that Mr Freeman had spoke.   It is an empirical fact in trauma studies that perpetrators suffer from trauma post the incident.  This has been well documented over many years.  The behaviors Mr Freeman displayed after the act, sounds just like text-book trauma.

Towards the end of the hearing, the judge spoke directly to Mr Freeman informing him of the consequences of pleading guilty and not guilty throughout the trial.  As if gratified by knowing that his victims would be tormented by the case dragging out and the possibility of it twisting into a great injustice, he stood proudly and said, "Not Guilty".  Silence filled the room, followed by an echo of pens in unison furiously scratching away at paper.  His face was devoid of all emotion but a twisted sense of triumph that spread across his face. After all, it is the last opportunity he has to torment his ex wife and family.

I give you permission to rape me...

I have been thinking on this....you know those adult women whose fathers locked up when they were kids and have raped them ever since....no media outlet has referred to any of those as consensual....but, how are they any different than this with MacKenzie?  Their fathers kept them locked up in rooms and her's kept her locked up in a drug induced stupor...what's the difference....I can't even begin to think I know enough about how any of them feel to analyze which scenario is worse....but dammit it was all rape and rape can not be fucking consensual...

I am appalled at our society and how it has taken on this “blame the victim” stance on EVERYTHING!  I am not just talking about incest and rape, DV or child abuse...I am talking about everything!  Why are we never asking the perpetrators why they did what they did?  Rather than always asking the ‘why’ question of the victim, we should be gathering up the perps and making THEM accountable for their reasons.  I know in this situation we can’t make this man responsible for his actions.

Because I can tell you this...there is no defense on this planet that is a good enough excuse for raping your own daughter!  Period.  I don’t care how you look at it, this is a horrible crime and so many of these so called ‘dads’ (term used so loosely, please read sperm donor) get by with this daily!!  Kids should not have to wait until they are adults to report their fathers raping them.  Or worse yet, in the case of the grown women that have been held captive for years by their fathers, they should not have had to wait all those years to be rescued.

When adult children do speak out about what happened to them as children, they are mostly met with much disbelief and blaming.  Why?  Because, raping our own children has become such a great past time in the world and the people with the power to put an end to this don’t want to give up the gig!  Here I am referring to the men who are raping their own kids!

Anyway...that was my little rant...read this from The Sexist

Sexist Beatdown: “Consensual Incest” And John Phillips Fanboys Edition

Posted by Amanda Hess on Sep. 25, 2009, at 9:27 am

Picture 71
“Ill tell you what the backlash is: You were old enough to know better.”

MacKenzie Phillips, daughter of Mamas & the Papas scribe John Phillips, star of One Day at a Time, daughter of Alexandria, Va., appeared on Oprah this week to tell the world that her father raped her for a decade.

Let’s see how Wikipedia treats such a revelation, on MacKenzie Phillips’ page: “According to an article in People magazine, she alleges in the book that at the age of 19, on the night before her first wedding, she ‘woke up that night from a blackout to find [herself] having sex with [her] own father’; both reportedly were under the influence of drugs at the time. Afterwards an incestuous relationship developed, lasting ten years.”

And in

John Phillips’ Wikipedia page: “In September 2009, John’s daughter Mackenzie Phillips alleged in a new memoir, High on Arrival, that she and her father had a consentual ten-year incestuous relationship. She stated that the relationship began when she was 19 years old in 1979, after Philips raped her while they were both under the influence of heavy narcotics on the eve of her first marriage.”

Woah woah woah! Did you see how they just dropped that “consensual” in there?

Whoever is editing MacKenzie’s page decided to leave consent issues out of it—the relationship “developed.” But editors of John Phillips’ Wikipedia page want to make sure that readers know the father-daughter incestuous relationship was totally mutual. The most recent contributor to the page decided to remove some scare quotes around the world “consensual.” Others have tried to scrub the whole incest thing out of his profile. One announced that they both “had planned to go burn in Hell together,” as blame should be distributed equally between a horrifically abusive father and his child. (Note: It’s not all rape apologists over at John’s page. Another contributor keeps editing Phillips’ “Occupation” to read “Musician, Rapist”).

So! Join me and Sady of Tiger Beatdown as we attempt to edit the Wikipedia pages of OUR MINDS to stop blaming the victim and start

SADY: oh, say, have you heard of any fairly famous stories of abuse and sexual assault that people are spinning in a totally alarmingly rape-culturey way lately? because I HAVE!

AMANDA: wait … you mean the consensual incest?

SADY: ha ha, YEAH. i played a little game, the day that story broke. it was called, How Many Headlines Are Not Totally Fucked Up?

AMANDA: how many!

SADY: here is your answer: i found two that were not! one was on MTV news and it read:  “Mackenzie Phillips Claims Her Father Raped, Drugged Her.” one was on E! and it read, “Mackenzie Phillips: I Was Raped By My Father.” now! you could find some problems with these headlines! BUT, every other source was like “Mackenzie Phillips Confesses Sex Affair With Dad.” leaving out the part where it became “consensual” after several rapes.[Note: Huffington Post has done pretty well on this too

AMANDA: and the part where it never becomes “consensual”! because it never can be! i was interested the differences in the media coverage of this incident and the Phillip Garrido incident. there’s a whole lot we don’t know about that situation, but whenever “sex” is mentioned between Garrido and his kidnapee, it’s usually at least referred to as rape. because you can’t kidnap a person and rape them and then raise them as your child/wife and have that slowly blossom into a consensual relationship. and this is the same thing, except—you can’t rate tragedies, but i’m gonna—worse? because he is the man with the responsibility to raise his child and he kidnapped her from her childhood and drugged her and raped her for decades.

SADY: yeah. i mean, here’s the thing. this reminded me a lot of anais nin, who started having “consensual” sex with her father as an adult. BUT: she also struggled to figure out whether these memories of him molesting her as a child were real or distorted or what (a PRETTY common thing for kids, who have trouble making sense of memories of molestation) and there’s no doubt that he was abusive to her in other ways. and, like, these are different cases. phillips’ started out, unambiguously, as sexual assault, and she named it as such. but then – here’s a thing i think is tricky to articulate so IF I FUCK UP TELL ME – it became “consensual,” to HER, but arose out of this context of abuse and drugs where she basically didn’t have the option of NOT being victimized in this way. like, i think that the whole “compliance is not consent” thing is important to articulate, because sometimes people tell themselves that what is happening is consensual just to deal with the fact that they don’t have an option of it NOT happening.

AMANDA: definitely. because even if you leave that relationship, that means severing one of the most important relationships in your life, your relationship with your father. and that’s not a real choice. especially when your father has been emotionally and physically—so many drugs!—prepping you to consent to this shit since age 10

SADY: right. exactly. it’s a thing a lot of people struggle with, whether it’s abusive family relationships or (HEY!) rape culture: when you’re receiving constant information to the effect that how you are treated is normal and OK and excusable, you – you, yourself! – may have trouble articulating that what was done to you was not OK.

AMANDA: i didn’t watch the oprah interview, but i was dismayed to hear how it went down. Oprah, as many know, was raped as a child as well. she’s interviewed a lot of victims of sexual assault on her show, and I think that’s great. but there’s still this very obvious manipulation of the interview for the general public – silently judging for Phillips continuing to GET RAPED after she turned 18, etc.

SADY: right. but her take can be sort of sensationalistic. and i have a problem with the Oprah Face – it’s something she does a lot in interviews, this thing of Making The Face You Imagine Your Audience To Be Making – so she looks “scandalized” when what is said is “scandalous” or etc.

AMANDA: yeah. and it’s so weird in a situation like this, because the news of this years-long abuse just hangs there. where do you go with it? it’s just objectively awful and terrible, but interviewers have tried to spice it up a little bit by judging which parts were most awful, and which parts were maybe her fault

SADY: actually, can i tell you my FAVORITE reactions? they were really special! and did not come from oprah!

AMANDA: sure!

SADY: my FAVORITE reactions have been those that are like, “this is so horrible! for my ENJOYMENT OF THE MUSIC OF JOHN PHILIPS!” which is closely tied to the Should She Have Said Anything At All? Maybe Not! debate, but that is fairly predictable and pedestrian silencing, whereas this – THIS! – demonstrates a bold and innovative approach to making the issues secondary to your own personal comfort.

AMANDA: i know. how is that even related? i’m reading a story about surviving rape, why the fuck do i care if someone does or does not like the mamas and the papas?

SADY: but that’s the thing! and this happens so often in cases of celebrity abuse. like, i believe that, when you and i discussed the chris brown and rihanna thing, you pointed out that a lot of people who covered it were just coming off a post where they drew jizz on a star’s face or whatever to express disapproval.

AMANDA: yeah.

SADY: when something like this is treated as a “celebrity story” (which it is, to some extent) rather than a story about sexual violence (which it is, to a larger extent, I would argue) there’s going to be lazy or uneducated or insensitive coverage. which isn’t to say that everyone in the whole wide world who writes about celebrities is lazy or uneducated or insensitive, because that’s blatantly untrue, but that people who don’t know shit are going to write their piece too.

AMANDA: and on that note: with this story in particular, i find the “Think of the Children” defense extremely bizarre. I mean, what kid is going to be reading and/or caring about news about John and Mackenzie Phillips? I barely knew who she was before I heard about this. If a parent had to explain incest or rape to a child because of this news (and ooooh, talking to your kid about abuse is such a baaad thing), they’re first going to have to explain who the fuck these people are, right?

SADY: yeah. totally true! but, i mean, speaking of talking about abuse… the reactions that have been like, “why did she tell us ewww” or “but what of my record collection?” have been rare(ish) and call-out-able.

AMANDA: Except from her own family! Bonus reaction of her step-mother, who was married to John at the time: “John was a good man who had the disease of alcoholism and drug addiction,” the statement read. “He was incapable, no matter how drunk or drugged he was, of having such a relationship with his own child.”

SADY: “Mackenzie has a lot of mental illness. She’s had a needle stuck up her arm for 35 years.”

AMANDA: I mean, the statement isn’t even like, “i had no awareness of this happening,” but rather, “he couldn’t have done this, he was too good!”

SADY: right! the drug abuse and mental health issues have NOTHING to do with potential trauma! she’s just a freakshow! also, john was cool!

AMANDA: yeah. SHE did a lot of drugs, so she can’t be trusted. HE did even more drugs, so he can’t be a rapist. it all makes sense!

SADY: i mean… on some level? because my heart is full of twinkly stars and daisies and unicorn dust? i want to see how this HUGE story, which is playing out in public and is right in front of everyone’s face, can actually illuminate for people how victim-blaming and misunderstandings of consent can work. like, with the family turning on her. and the accusations that she just wants attention. and the minimizing of the word “rape” and widespread use of the word “sex.” these things are so common in MUCH SMALLER STORIES and i want to believe that seeing them, and seeing a conversation around them, is going to show people how fucked-up they are.

AMANDA: i’ll believe it when i see it

SADY: yeah. i mean, what’s typically going to happen is that voices who call shit out are going to be called fringe and unreasonable and mean and blah de blee blah bloo. but, you know. people are talking about incest now. and what with how little we all seem to get about it, given how it’s been covered? i hope to God at least some of us are going to REALIZE how little we get it, and move in the getting-it direction.

AMANDA: i agree that that much will probably happen. i hope.

Mom who fled Iowa for safety ordered back

Please just read this!  Stories like this are being printed all across America and no one seems to realize that women who try to protect themselves only end up getting abused again by the Family Court system.  When are people in this country going to wake up?  Battered women and children are dying all over this country and yet, judges see nothing wrong with what they are doing when they force a woman and her kids back into an area where they are probably going to be killed.

Battered women do not flee the area for shits and grins!  No one likes moving. So, why in the hell would someone do so without a good reason?  I can answer that one...THEY WOULDN’T!  No mother is going to drag her kids all over the place and keep them in totally upheaval for anything less than to save their lives!  Even the most well planned out moves that ordinary people make for good reasons are stressful and no one really likes it.  If a mother didn’t care about her children she would just stay in the area and not go through it all!

A Decatur County woman who said she fled the state fearing for her life and that of her 7-year-old son is being required to return or risk being arrested.
Ringgold County Attorney Clint Spurrier has thus far rejected pleas from advocates of domestic-violence victims to drop a criminal complaint against Hannah Newberry for violating the visitation arrangement from her divorce in June. If Newberry returns to Iowa for a family court hearing today, she could be arrested - and possibly lose custody of her son, she said.

"This to me is blackmail," said Newberry, who was awarded sole physical custody of the couple's son. "I left to protect myself. They're trying to make me a criminal even though I'm not the one who has done anything wrong."
Newberry, 47, originally of Lamoni, said she fled to Ohio on June 12 because of escalating harassment by her former husband, Timothy Newberry.
Iowa's Department of Human Services has confirmed several cases of abusive behavior by Timothy Newberry. Two alleged violations of protection orders brought by Hannah Newberry were dropped this summer because she would not return to Iowa to testify against her ex-husband.

Timothy Newberry could not be reached for comment.
Spurrier said he was appointed to the case only recently because Decatur's county attorney had a conflict. Spurrier also said that until Hannah Newberry appears in court, where she will be represented by an attorney, there is little he can do. A charge is already on file, and a warrant for her arrest was issued.
"When she returns, it would be my anticipation that she turns herself in so arrangements can be made for her release," Spurrier said.

He added that he is restricted in what he can say to a defendant without an attorney present. "I don't think there's any intention to hold her in jail," he said.
A national organization called Stop Family Violence has made appeals to Iowa's attorney general, Gov. Chet Culver and Chief Justice Arthur Gamble to intervene in the case. The organization's members also pleaded to Spurrier in letters, saying Hannah Newberry is in a no-win situation: If she returns, she can be arrested and puts herself or her son at risk. If she is jailed, Timothy Newberry can petition the court to regain custody of their son.

Timothy Newberry "has a long, documented history of severe domestic and child abuse spanning 30 years and two additional wives," the group wrote Culver on Sept. 4.
Miller and Culver did not respond; Gamble wrote back saying he could not intervene under state law, the organization said.
Stop Family Violence said all three of Timothy Newberry's previous wives obtained orders of protection from him. A child-abuse report written four years ago said Newberry's violent temper "appears to be becoming progressively worse." The social worker said she feared for the safety of his children and recommended that Newberry, 51, have only supervised visits with his children.

A copy of an Iowa Department of Human Services child-abuse assessment obtained by The Des Moines Register shows Timothy Newberry was found responsible for child abuse for trying to choke his wife while she was holding their 3-year-old son in March 2005. He had three similar confirmed, or founded, child-abuse reports, in November 1990, in 1998 and in 2004.

According to a social worker's report, the 2005 incident was spurred when Hannah Newberry tried to leave the home because her husband was in such a foul mood. He began to choke her, blocked the door and smiled as she struggled, saying " 'Oh, good - struggle. Go ahead. I bet you want to call 911, don't you?' " according to the DHS report.
Eventually Hannah Newberry managed to escape, and the police arrived.

Take a look at the figures; 90% of families being killed by dear dad

Over 90% of Familicides are Fathers Killing Their Families

from RightsForMothers.com by justice4mothers

Can’t say that I agree the with this explantion of motivating factor for familicide. But the fact that 196 of 211 familicides were committed by men (92.89%) shows that murder of family members are being committed by MALES more than 90% of the time. True to the Violence Policy Center’s prior studies.

Expert: Rate Of Familicides Rising

Peter Busch
Reporter, KPHO.com

FLAGSTAFF, Ariz. — A criminal justice professor said familicide, a crime in which a parent kills his or her family, is on the rise.”We’ve noticed over the past year a marked increase in familicides nationally,” said Neil Websdale, a professor at Northern Arizona University.Websdale believes the recession is one of the reasons behind the spike.”I think what’s happening is perpetrators are killing because they somehow perceive that they have failed as providers, lovers, fathers, and in a small number of cases, wives and mothers,” he said.

Websdale just wrote the book Familicidal Hearts, which will be released in January. In the book, he looked at 211 cases of familicide. In 196 of those cases, the father was the killer.Websdale said the recent murder-suicide in Mesa where a mother apparently killed her two teenage sons before killing herself is the exception to the rule.”Without knowing all the facts, it’s tough to say what was behind it — but it definitely looks like a rare case,” he said.

Why Are They Dead?

The Family Courts around the world are sentencing our children to death, by enforcing visitations and custody with abusive parents.  This site not only provides research about this ever growing problem but is also a tribute to those that have bee killed at the hands of their abuser because of court orders.

Below is an excerpt from Family Court Murders

The Untied Nations definition of Genocide set out in the Convention on Genocide is:

Article 2

In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:

  • (a) Killing members of the group;
  • (b) Causing serious bodily or mental harm to members of the group;
  • (c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
  • (d) Imposing measures intended to prevent births within the group;
  • (e) Forcibly transferring children of the group to another group.

In the news, it is common to see these murders blamed on the economy or the stress associated with divorce.

Unless you are a keen researcher, you are not privy to knowing what academics and even the UN knew for years

A silent but deadly genocide against women and children where authorities have had many opportunities to eliminate the root cause, but chose not to.

In every case these deaths are a result of child custody disputes where the court knows of a violent history, but decides to gamble with their lives for the sake of "fathers rights".

“My child and I have been threatened and intimidated by the possibility that I may go to jail and be held in contempt due to my child refusing to have visitation with her abusive father and she may go to foster care.” Her father has told her this over and over again, as well as Judge David Miron.

This is not the first time that this mother has had to protect her child from the father. Oconto County CPS did substantiate sexual abuse allegations against the the father, he found a loop hole and had the recused Family Court Commissioner, Frank M. Calvert unsubstantiated the sexual abuse allegations.

The system has failed my child, from Oconto County and its CPS worker, Carrie Silbernagel-Burke to Marinette County Circuit Court Judge, David Miron.

This father does not have the means to care for her. She has no bed or a bedroom due to the fact he lives with his mother who only has two bedrooms.

The 11 yr old child is given the choice to sleep either on the floor in the living room or down in the basement. She has no privacy or space to call her own while she is in her fathers care. She is continually tormented and tortured by both her paternal grandmother and father, this is nothing new.

This child has been exposed to domestic violence by her father towards her mother several times. She was also a passenger in his car when he was arrested for driving drunk in the middle of the day. The CPS worker, Carrie Silbernagel-Burke told the mother:

“drinking and driving with his daughter did not make him a bad father, he made a bad choice.”

This was nothing compared to the sexual abuse my child endured and other court ordered abuse.

My child has taken her stand against her abuser, the court ordered abuse and threats of foster care by Judge David Miron.

My child is not an empty vessel, she KNOWS where she is safe. She has not lied to social workers, even with her father prodding her to.

All her needs are provided by her loving Mother and she knows that

“I am not going to shut up, give up or go away!”

“My only wish is for my daughter to be safe and sane.”

If this mother is jailed for doing what any mother would do for her child

the consequences to my accusers and judges will be as follows.

There will be a hunger strike (Troscadh), and all the battles up until now were training for we intend to win the war and expose the dirty little secrets of family court and the criminals that run it.

Educating Dads May Help Protect Babies From Abuse: New 2009 Study

A new study paints a heartbreaking portrait of babies who die from child abuse — and suggests new ways to protect children.  More than half of the babies and toddlers showed signs of previous abuse, according to a study of 72 deaths of children under age 2, published online this week in Pediatrics. The study included data from five states and seven cities.

Babies this age, who are vulnerable in so many ways, are also among the most likely of all children to be victims of homicide, the study says.

More than 2,400 children under 2 were murdered in the USA from 2001 to 2005, almost twice the number killed in car accidents, the study says. Children this age account for about half of all homicides of children under 14. The murder rate for babies this age — 6 per 100,000 children — is 10 times higher than the rate for children 7 to 8 years old, and even higher than the rate for 15- and 16-year-olds, the study says.

In the study, the largest number of babies died after being shaken to death, often because of crying.

Many of these deaths may be preventable, because evidence suggests that the perpetrators act out of frustration and ignorance rather than a desire to harm, says co-author Takeo Fujiwara the of Harvard School of Public Health.

The study also shows that child advocates need to do a better job of educating men about ways to cope with crying, says Carole Jenny, a spokeswoman for the American Academy of Pediatrics on child abuse.

More than 70% of perpetrators in the study were male. That’s striking, given that women often spend more time with infants, says co-author Catherine Barber, also of Harvard.

There’s no national system to educate parents about shaken baby syndrome before they leave the hospital, Jenny says. Although 14 states require that new parents receive information before leaving the hospital, states rarely provide money to fund these programs, says Philip Scribano, medical director of the Center for Child and Family Advocacy at the Ohio State University College of Medicine.

Although home visiting and hospital-based educational programs have had some success, many efforts fail to include fathers, he says.

“The message to fathers should be, ‘Don’t shake a baby,’ ” says Jenny, who notes that for every baby that dies from being shaken, seven or eight suffer brain damage, blindness or other injuries. “If you get angry, put the baby down and ask for help.”

"Dad" takes 2-month-old girl from women's shelter (with their permission) and kills her

This brought to us by Dastardly Dads...their comment says enough, I feel no need to add to it!

"Dad" takes 2-month-old girl from women's shelter (with their permission) and kills her (Singapore, Singapore)

    This story is freaking unbelievable.

SARLE STEEPAN KOKUNDU, who falsely declared he was the biological father of his girlfriend's two-month-old daughter when the birth was registered, attacks the girlfriend at work while drunk for "not telling him that she was working" and other random accusations (typical abuser/control freak stuff). He pushes the girlfriend and punches her in the head. The police are called. They apparently don't arrest this goon, they just tell him to leave (mistake #1). Mom was staying at a women's shelter called the Good Shepherd Centre at the time--apparently a shelter run by complete idiots and incompetents (mistake #2). Dad then goes to the shelter, lies, and says that the mother gave him "permission" to take the child out. AND THESE MORONS HAND OVER THE KID! NO PROOF, NO NOTHING! (mistake #3). Virtually as soon as he gets the baby out of there, the "seething" dad slaps her and "roughs her up" till she is bleeding from the mouth. A passerby notices that the baby is blue and motionless, and alerts the staff at the shelter, who call for an ambulance. Apparently these nitwits didn't notice that the man who had just picked up a baby from their shelter was literally beating the sh-- out of this kid just outside their door. (mistake #4). And this POS actually rides in the ambulance to the hospital with the baby! (mistake #5). Later that night, the baby dies from a fractured skull, and the "dad" is arrested for murder.
What good are DV shelters when they pull this crap?

    Man admits killing baby
He repeatedly slapped two-month-old girl, who died from skull fractures

    By Selina Lum

AFTER attacking his girlfriend at her workplace, a man went to the women's shelter where she was staying and asked for her two-month-old baby girl. Sarle Steepan Kolundu, 44, was registered as the infant's biological father - even though he was not - and he was allowed to take her out.

He was still seething when he took the baby, and he slapped and roughed her up until she was bleeding profusely from the mouth. They were just metres from the shelter, the Good Shepherd Centre.

A passer-by, seeing that the baby had turned blue and was motionless, alerted staff at the shelter, who called for an ambulance.

The infant, Esther Regina Sarle Steepan, died in hospital from skull fractures. Sarle Steepan, who went in the ambulance with her, was arrested at the hospital that night. He was initially charged with murder, which carries the death penalty, for killing the baby on June 1 last year.
But on Wednesday, on what would have been the start of a 13-day trial in the High Court, he pleaded guilty to a lesser charge of culpable homicide not amounting to murder.

He faces life in prison or up to 20 years' jail and can also be caned or fined. Next Monday, the prosecution will argue its case for sentencing and the defence will plead for leniency.

The court heard that Sarle Steepan and Ms Siti Noor Fazlina Haron, 24, entered into a relationship soon after they met in August 2007. For a while, they lived together in a rented flat, but moved out shortly in February last year. Ms Siti was then pregnant with another man's child.
Esther Regina was born on March 27 last year. Sarle Steepan knew he was not the biological father, but falsely declared that he was while registering her birth in May. Later that month, he began suspecting that Ms Siti was cheating on him.

On the evening of June 1 last year, reeking of alcohol, he showed up at the shopping mall where she worked and created a scene. He berated her for not telling him that she was working, pushed her and repeatedly punched her on the head.

The police were called in and they advised him to leave. He then cycled to the shelter and lied that Ms Siti had given him permission to take the baby out.

After the baby was handed to him, he pushed her in a pram to the void deck of the block. After his arrest, Sarle Steepan admitted that he had repeatedly slapped the baby in anger. An autopsy report said the skull fractures showed that the blows to the baby's head were of 'considerable force' and were highly unlikely to have been caused accidentally.

Child molesting dad/granddad gets slap on the wrist

Shit like this pisses me off!!  They quote:

Crown Prosecutor Gary Corr said, "It was one of the worst cases of child abuse I have ever seen.

But the asshole only got 19 fucking years??  And, will be eligible for parole in 12-13 years??  Gee, let me think....what about what he did in the way of fucking up those two (well and according to the article this wasn't the first time, another girl back in the 90's) little girls lives!  They aren't going to be all better in another 12-13 years....also, if he did this before, way back when....he didn't stop, he just didn't get caught again until recently!!  He should be locked up for life!  Or killed....I personally prefer dead!  Castration doesn’t stop these monsters, nor does short jail terms.  This sends the message that child molesters and child porn distributors will just get a slap on the wrist and be free to go about their business.

    Original:  http://www.news.com.au/story/0,27574,26065654-421,00.html

A FIREFIGHTER, who led a double life selling images of his naked daughter and granddaughter online to pedophiles around the world, has been jailed for 19 years.

The 40-year-old, who cannot be named to protect the children, videoed and photographed acts of sexual abuse he inflicted on his six-year-old daughter and four-month-old granddaughter on at least 10 occasions in 2007.

The father-of-five, who worked as a casual firefighter with the NSW Fire Brigade, tried to establish an international child-porn-selling ring using the Google chat room program Hello, to sell the photos and videos of the two girls in packages for $10,000.

His arrest came after his operation was discovered in a collaborative investigation by FBI officers in the US and the Australian Federal Police.

Court files revealed the man, who in 2000 worked as a bus driver transporting spectators to Sydney Olympic events, had filmed his daughter dancing naked in the bathroom.

    Related Coverage

He had also photographed himself raping and sexually assaulting her on numerous occasions, at times using a webcam.

He referred to his daughter as a "sexual pearl" in chat rooms and had showed child-porn images to the girl to make her feel comfortable posing.

He also took photos of himself sexually assaulting his four-month-old granddaughter he was meant to be babysitting for his then 20-year-old son in July, 2007.

The horrifying acts were committed in his southern NSW home where he lived with his wife and three young children, aged seven, six and three months at the time of the assaults.

His 28-year-old wife of six years had no idea of the double life her husband was living.

Court documents revealed the man had contacted at least 15 child-porn buyers and had negotiated a sale with one before he was arrested in September, 2007.

Police investigation showed the man had sexually assaulted another 11-year-old girl on an ongoing basis prior to 1997.

On September 4, he was sentenced to 19 years jail in the Sydney District Court. He will not be eligible for parole until March, 2022.

His wife has now relocated to a secret location in the hope that her husband will never find her when released from prison.

With the sickening details of the man's actions played out in the court room, Crown Prosecutor Gary Corr said, "It was one of the worst cases of child abuse I have ever seen.

"The problem was not so much that we had to show the photos in the court room, but stopping the jury members from jumping the rails and beating him to death when we did."

The man pleaded guilty to all charges which included indecently assaulting and having sexual intercourse with children aged under 10 and 14, and possessing and making child porn available on the internet.

The man did not speak during the trial except to plead guilty. His wife told police the couple had always had a "fairly inactive sex life" and that there had been "a normal father-daughter relationship" between father and daughter, court documents said.

During interviews with police she was astonished to discover the truth of the man's double life. He is now on 24-hour suicide watch in prison.

FBI officers in the US tipped off AFP investigators that the father had been distributing naked images of his granddaughter to a Florida man.

AFP officers found the man masquerading online as a 12-year-old under the user name of "firemansam2007".

A raid at the house recovered the man's laptop and a 320 gigabyte external hard drive, which contained more than 132,000 child-porn images.
