Abused Mom Wants Unsupervised Visits with Daughter

Wichita grandparents try to appeal to Kansas legislature

This was actually a forwarded email, however since the original writer of the email asked that this be passed on, in an attempt to gain national coverage of what is transpiring in Kansas, I decided to share via blog rather than email.  Feel free to pass on the story of this family.

Wichita grandparents try to appeal to Kansas legislature to help "felon" daughter with child custody

There is a warrant out in Wichita for the arrest of Cecillia Arnold, who was an abused mom. Arnold's crime? She talked to her daughter who is in foster care:

http://kansas.watchdog.org/2890/warrant-out-for-mom-who-testified-at-hearing-about-losing-custody-of-children/ ...

On Thursday in Topeka Cecillia's parents tried to ask a committee in the Kansas legislature for help with their daughter's plight.  These grandparents don't understand why their daughter was denied custody, and why they have been denied custody of their granddaughters.  Direct link to YouTube video from Thursday:  http://www.youtube.com/watch?v=Sn1zFnX2GnI

Grandparents Albert and Monica Arnold also attended hearings at the State Capitol on Nov 30, 2009.  In both cases, the committees did not have time to listen to their appeals, however, their daughter Cecillia was allowed to speak in Nov.  Listen to her testimony on this page:

Cecillia and her parents are in this video from last year:  http://kansas.watchdog.org/1978/parents-grandparents-ask-why-children-removed-from-homes/

Please forward.  We need to find a national voice to speak for Cecillia and her parents, who do not have the money to fight their case in court.

Compelling stories from parents and grandparents about problems with placement and removal of children

By Earl Glynn On December 4, 2009

Abused mom Cecillia Arnold lost her parental rights. She wants her kids back.

“I did all court orders and my girls were placed back home with me”

“The case workers changed many times. I couldn’t get through to them sometimes.”

“The reintegration itself … was going well”

“I had stability. I had a home. I had a job. I had everything that they would ask someone to do for reintegration to occur.”

“My abuser … was going to jail at the time at the time the girls were removed from home. He was incarcerated for, I think, it was two years for the crime he committed against me.”

“The girls were removed from home for the second time.”

“The assistant [Sedgwick County] DA … filed a petition for termination [of parental rights], and after … the trial termination was granted.”

“As of now I have not seen my children since March of this year”

“During the trial I had testimony from different people — the foster care parents … — their testimony was overlooked.”

“… bad experiences with DCCA …”

“They said the reason for termination was … me not following the reintegration plan. That was not true.”

“… the ball got dropped on me from the Agency that was contracted through the courts … They didn’t do the job that they were supposed to do, which resulted in my girls being removed from home”

Senator Oletha Faust-Goudeau: “Her parents are in the audience … They have been denied custody of their grandchildren, too, and told there were too old; they were too sick.”

State Rep Bill Otto (R-LeRoy): “Your rights are severed?”

Arnold: “My rights have been terminated … I have no rights to my children. I have not seen them since March. I filed an appeal that didn’t go anywhere. I’m here today because I want my children back.” …

Otto: “Where was your lawyer?” …

Arnold: “I had court-appointed attorneys … I feel I could have done a better job representing myself” ..

Otto: “This should not happen to anybody … I’m so sorry.” …

Chair Kiegerl: “Your problem mainly is with the courts, although, I’m sure, the agency’s testimony was instrumental in the decision. … My heart goes out to you …I wish there were a magic wand that … we could use to solve your problem.”

    Arnold left in tears.

Testimony on Domestic Violence Law in Kansas to be Heard

Kansas lawmakers to hear testimony on domestic violence law

    Newton Kansan  Posted Jan 29, 2010 @ 05:00 PM

TOPEKA — At 1:30 p.m. Monday, (State Capitol Rm S-144) members of the House Committee on Corrections and Juvenile Justice will hear testimony about proposed legislation that will assist the criminal justice system in documenting crimes associated with domestic violence and track repeated offenders.

Curt and Christie Brungardt, parents of the late Jana Mackey, will speak in support of the proposed legislation. Jana Mackey, a 25-year-old KU Law student was murdered by her ex-boyfriend in July 2008. Recently the Brungardts have created Jana’s Campaign to Stop Domestic Violence to encourage and promote a public policy response to domestic violence. “We believe it is our responsibility to use the story of Jana’s life and the story of her death to help reduce violence against women.” The campaign’s goal is to promote new and effective legislation that will secure safety and justice for victims of domestic violence. “It is our deep desire to turn this tragedy into something positive and play a significant role in reducing domestic violence.”

House Bill 2517 requires a domestic violence tag be placed on all legal documents associated with a criminal act that is based on an intimate relationship. Having this DV tag is especially important as offenders often repeat their crimes against victims. Therefore, this legislation encourages sanctions to be put in place before violence escalates.

Others testifying at the hearing include representatives from the Attorney General’s office, the Governor’s Domestic Violence Fatality Review Board, Department of Corrections, law enforcement, and the Kansas Coalition Against Sexual and
