Loophole in the system allows sex offender step-dad to continue living in house with two young kids

This one really got to me.  I have edited and re-edited my comments to this, because I am so mad I can not even form a complete sentence.

First, off who wrote this damn law, and how would they feel if their little ‘loophole’ had trapped their own young kids??

Secondly, what in the hell is this mother thinking?  As a mother there ain’t no fucking way my kids and I would still be in that house!  Ok, so since I don’t know her; maybe she didn’t know before she married the slime ball.  But, now that she knows; WHY in the hell is she still there?  There ain’t no dick on this planet that is worth the risk to the kids!!

Third, and most importantly...my thoughts and prayers are with those two little kids that are caught in this mess!  I sincerely hope that nothing happens to them!

Man's Children Share Home With Convicted Sex Offender
Posted: Sep 16, 2009 7:36 PM EDT Wednesday, September 16, 2009 7:36 PM EST

NASHVILLE, Tenn. - Mike Miguel said his two young children are living with a sex offender, and there's nothing he can do to stop it. A legal loophole has the father frustrated.

Miguel's nightmare started with an internet search. He typed in the new address where his two children would be living with his ex-wife and their new step-dad.

"Here comes his name and picture on the TBI website for a sex offender," said Miguel. "Everyday is a new fear."

The man living with his 7-year-old and 9-year-old was a sex offender, convicted of uploading pornographic pictures of children.

"Now my kids are there everyday, taking baths and showers, just running around the house in their underwear, whatever they are doing. How is he looking at my children?" said Miguel.

Miguel pushed for an emergency court hearing to get custody of his children because he thought state law was on his side. State lawmakers did pass legislation that if a sex offender commits a crime against a child younger than 13, they would not be allowed to live in a home with a minor.

In Miguel's case because the offender was uploading child pornography, it's hard for investigators to prove the identity of the young victims, and find out exactly how old they are.

"It starts to drive you a little crazy," said Miguel.

Miguel has to make due with waiting until May. That's when once again he'll go before a judge to try and get custody of his two children.

"Everyday I walk by my kids pictures and I look at them, and think I just don't know. You wonder what's going on, what's happening, Is there anything happening, is there not, but you can't do anything about it," said Miguel.

Miguel was pushing to change state law when it comes to the legal loophole. He's been in touch with State Representative Susan Lynn. Lynn's looking into creating a bill that could resolve the issue when they go back into session in January.

Rep. Lynn is also looking into another issue impacting juveniles and sex offenders. Minors only have one year to report a sexual assault to investigators. Lynn wanted to extend that period of time.

Educating Dads May Help Protect Babies From Abuse: New 2009 Study

A new study paints a heartbreaking portrait of babies who die from child abuse — and suggests new ways to protect children.  More than half of the babies and toddlers showed signs of previous abuse, according to a study of 72 deaths of children under age 2, published online this week in Pediatrics. The study included data from five states and seven cities.

Babies this age, who are vulnerable in so many ways, are also among the most likely of all children to be victims of homicide, the study says.

More than 2,400 children under 2 were murdered in the USA from 2001 to 2005, almost twice the number killed in car accidents, the study says. Children this age account for about half of all homicides of children under 14. The murder rate for babies this age — 6 per 100,000 children — is 10 times higher than the rate for children 7 to 8 years old, and even higher than the rate for 15- and 16-year-olds, the study says.

In the study, the largest number of babies died after being shaken to death, often because of crying.

Many of these deaths may be preventable, because evidence suggests that the perpetrators act out of frustration and ignorance rather than a desire to harm, says co-author Takeo Fujiwara the of Harvard School of Public Health.

The study also shows that child advocates need to do a better job of educating men about ways to cope with crying, says Carole Jenny, a spokeswoman for the American Academy of Pediatrics on child abuse.

More than 70% of perpetrators in the study were male. That’s striking, given that women often spend more time with infants, says co-author Catherine Barber, also of Harvard.

There’s no national system to educate parents about shaken baby syndrome before they leave the hospital, Jenny says. Although 14 states require that new parents receive information before leaving the hospital, states rarely provide money to fund these programs, says Philip Scribano, medical director of the Center for Child and Family Advocacy at the Ohio State University College of Medicine.

Although home visiting and hospital-based educational programs have had some success, many efforts fail to include fathers, he says.

“The message to fathers should be, ‘Don’t shake a baby,’ ” says Jenny, who notes that for every baby that dies from being shaken, seven or eight suffer brain damage, blindness or other injuries. “If you get angry, put the baby down and ask for help.”

Dastardly Dads: Recent Studies on Child Abuse and Neglect

Silverside over at Dastardly Dads has done an excellent article on studies of child abuse and neglect.  Here’s part of it...please go to the link after the excerpt and read the whole thing...it is well worth it!

Recently, a fathers rights guy reemed me out for taking another look at The Third National Incidence Study of Child Abuse and Neglect (NIS-3), because that's just "old" data.

http://dastardlydads.blogspot.com/2009/09/another-look-see-at-nis-3-or-what-do.html

I know that often these guys don't have the best reading comprehension skills, so I'm not surprised that he missed the fact that I acknowledged the age of the data right from the beginning (the study itself is 13 years old; the raw data older than that). I also mentioned specifically that:
1)That NIS-4 is not available yet
2) That NIS-3 is still widely quoted all across the political spectrum, even though most bloggers never appeared to have looked at anything but the inco...More here:  Dastardly Dads: Recent Studies on Child Abuse and Neglect: The Role of Fathers in Risk for Child Abuse and Neglect (2005)

"Dad" takes 2-month-old girl from women's shelter (with their permission) and kills her

This brought to us by Dastardly Dads...their comment says enough, I feel no need to add to it!

"Dad" takes 2-month-old girl from women's shelter (with their permission) and kills her (Singapore, Singapore)

This story is freaking unbelievable.

SARLE STEEPAN KOKUNDU, who falsely declared he was the biological father of his girlfriend's two-month-old daughter when the birth was registered, attacks the girlfriend at work while drunk for "not telling him that she was working" and other random accusations (typical abuser/control freak stuff). He pushes the girlfriend and punches her in the head. The police are called. They apparently don't arrest this goon, they just tell him to leave (mistake #1). Mom was staying at a women's shelter called the Good Shepherd Centre at the time--apparently a shelter run by complete idiots and incompetents (mistake #2). Dad then goes to the shelter, lies, and says that the mother gave him "permission" to take the child out. AND THESE MORONS HAND OVER THE KID! NO PROOF, NO NOTHING! (mistake #3). Virtually as soon as he gets the baby out of there, the "seething" dad slaps her and "roughs her up" till she is bleeding from the mouth. A passerby notices that the baby is blue and motionless, and alerts the staff at the shelter, who call for an ambulance. Apparently these nitwits didn't notice that the man who had just picked up a baby from their shelter was literally beating the sh-- out of this kid just outside their door. (mistake #4). And this POS actually rides in the ambulance to the hospital with the baby! (mistake #5). Later that night, the baby dies from a fractured skull, and the "dad" is arrested for murder.
What good are DV shelters when they pull this crap?

Man admits killing baby
He repeatedly slapped two-month-old girl, who died from skull fractures

By Selina Lum

AFTER attacking his girlfriend at her workplace, a man went to the women's shelter where she was staying and asked for her two-month-old baby girl. Sarle Steepan Kolundu, 44, was registered as the infant's biological father - even though he was not - and he was allowed to take her out.

He was still seething when he took the baby, and he slapped and roughed her up until she was bleeding profusely from the mouth. They were just metres from the shelter, the Good Shepherd Centre.

A passer-by, seeing that the baby had turned blue and was motionless, alerted staff at the shelter, who called for an ambulance.

The infant, Esther Regina Sarle Steepan, died in hospital from skull fractures. Sarle Steepan, who went in the ambulance with her, was arrested at the hospital that night. He was initially charged with murder, which carries the death penalty, for killing the baby on June 1 last year.
But on Wednesday, on what would have been the start of a 13-day trial in the High Court, he pleaded guilty to a lesser charge of culpable homicide not amounting to murder.

He faces life in prison or up to 20 years' jail and can also be caned or fined. Next Monday, the prosecution will argue its case for sentencing and the defence will plead for leniency.

The court heard that Sarle Steepan and Ms Siti Noor Fazlina Haron, 24, entered into a relationship soon after they met in August 2007. For a while, they lived together in a rented flat, but moved out shortly in February last year. Ms Siti was then pregnant with another man's child.
Esther Regina was born on March 27 last year. Sarle Steepan knew he was not the biological father, but falsely declared that he was while registering her birth in May. Later that month, he began suspecting that Ms Siti was cheating on him.

On the evening of June 1 last year, reeking of alcohol, he showed up at the shopping mall where she worked and created a scene. He berated her for not telling him that she was working, pushed her and repeatedly punched her on the head.

The police were called in and they advised him to leave. He then cycled to the shelter and lied that Ms Siti had given him permission to take the baby out.

After the baby was handed to him, he pushed her in a pram to the void deck of the block. After his arrest, Sarle Steepan admitted that he had repeatedly slapped the baby in anger. An autopsy report said the skull fractures showed that the blows to the baby's head were of 'considerable force' and were highly unlikely to have been caused accidentally.

Child molesting dad/granddad gets slap on the wrist

Shit like this pisses me off!!  They quote:

Crown Prosecutor Gary Corr said, "It was one of the worst cases of child abuse I have ever seen.

But the asshole only got 19 fucking years??  And, will be eligible for parole in 12-13 years??  Gee, let me think....what about what he did in the way of fucking up those two (well and according to the article this wasn't the first time, another girl back in the 90's) little girls lives!  They aren't going to be all better in another 12-13 years....also, if he did this before, way back when....he didn't stop, he just didn't get caught again until recently!!  He should be locked up for life!  Or killed....I personally prefer dead!  Castration doesn’t stop these monsters, nor does short jail terms.  This sends the message that child molesters and child porn distributors will just get a slap on the wrist and be free to go about their business.

A FIREFIGHTER, who led a double life selling images of his naked daughter and granddaughter online to pedophiles around the world, has been jailed for 19 years.

The 40-year-old, who cannot be named to protect the children, videoed and photographed acts of sexual abuse he inflicted on his six-year-old daughter and four-month-old granddaughter on at least 10 occasions in 2007.

The father-of-five, who worked as a casual firefighter with the NSW Fire Brigade, tried to establish an international child-porn-selling ring using the Google chat room program Hello, to sell the photos and videos of the two girls in packages for $10,000.

His arrest came after his operation was discovered in a collaborative investigation by FBI officers in the US and the Australian Federal Police.

Court files revealed the man, who in 2000 worked as a bus driver transporting spectators to Sydney Olympic events, had filmed his daughter dancing naked in the bathroom.

He had also photographed himself raping and sexually assaulting her on numerous occasions, at times using a webcam.

He referred to his daughter as a "sexual pearl" in chat rooms and had showed child-porn images to the girl to make her feel comfortable posing.

He also took photos of himself sexually assaulting his four-month-old granddaughter he was meant to be babysitting for his then 20-year-old son in July, 2007.

The horrifying acts were committed in his southern NSW home where he lived with his wife and three young children, aged seven, six and three months at the time of the assaults.

His 28-year-old wife of six years had no idea of the double life her husband was living.

Court documents revealed the man had contacted at least 15 child-porn buyers and had negotiated a sale with one before he was arrested in September, 2007.

Police investigation showed the man had sexually assaulted another 11-year-old girl on an ongoing basis prior to 1997.

On September 4, he was sentenced to 19 years jail in the Sydney District Court. He will not be eligible for parole until March, 2022.

His wife has now relocated to a secret location in the hope that her husband will never find her when released from prison.

With the sickening details of the man's actions played out in the court room, Crown Prosecutor Gary Corr said, "It was one of the worst cases of child abuse I have ever seen.

"The problem was not so much that we had to show the photos in the court room, but stopping the jury members from jumping the rails and beating him to death when we did."

The man pleaded guilty to all charges which included indecently assaulting and having sexual intercourse with children aged under 10 and 14, and possessing and making child porn available on the internet.

The man did not speak during the trial except to plead guilty. His wife told police the couple had always had a "fairly inactive sex life" and that there had been "a normal father-daughter relationship" between father and daughter, court documents said.

During interviews with police she was astonished to discover the truth of the man's double life. He is now on 24-hour suicide watch in prison.

FBI officers in the US tipped off AFP investigators that the father had been distributing naked images of his granddaughter to a Florida man.

AFP officers found the man masquerading online as a 12-year-old under the user name of "firemansam2007".

A raid at the house recovered the man's laptop and a 320 gigabyte external hard drive, which contained more than 132,000 child-porn images.
